Alabama Medical Insurance Laws, Regulations & Policies

In Alabama, the individual health insurance market is largely unregulated. State law does not require guaranteed issued coverage for any kind of individual health insurance plan. However, Alabama health insurance law does make group health insurance for small groups of two to 50 guaranteed issue.

Alabama medical insurance plans are required to cover cancer screening for prostate, breast and colorectal cancer. Alabama insurance providers are also required to uphold mental health parity, which means that mental health conditions must have coverage limits and maximums set equal to those for physical conditions. Yet insurance companies in Alabama are allowed to consider pregnancy a pre-existing condition and may restrict coverage to pregnant women applying for a plan. Residents with pre-existing conditions have access to coverage through the state’s high risk pool, often at higher costs.

All policyholders in Alabama group health plans are protected under the federal law HIPAA, and eligible residents also have a right to COBRA coverage as well. HIPAA reduces the limits for pre-existing conditions under any new coverage, and ensures that companies cannot require exclusions or waiting periods. Because the federal law makes employees eligible for COBRA only in companies with more than 20 workers, Alabama has enacted a state expansion law that allows all employees to have access to COBRA coverage for a temporary time period after leaving a group health plan. The Public Education Employees’ Health Insurance Plan (PEEHIP) provides financial assistance to qualifying Alabama public education employees and their dependents. Alabama Health Insurance High Risk Pool
The Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. The Pre-Existing Condition Insurance Plan (PCIP) for residents in Alabama is not a public program and enrollees will pay monthly premiums and out-of-pocket costs similar to normal Alabama medical insurance plans.

Recipients of Alabama’s PCIP will pay around the same amount that people without pre-existing conditions pay on the private insurance market. The estimated monthly premium rates for the Alabama health insurance high risk pool are $338 for ages 0 to 34; $406 for ages 35 to 44; $518 for ages 45 to 54 and $721 for people over 55 years of age. Alabama enrollees are required to pay a $2,500 deductible for covered health care services before the high risk plan kicks in. There are also affordable copayments for doctor visits and prescriptions.

Residents are eligible to enroll in the Alabama Pre-Existing Condition Insurance Plan if they are a United States’ citizen, have an existing medical condition, and have been uninsured for six months.
