Kentucky Medical Insurance Laws, Regulations & Policies

There are several Kentucky health insurance laws and regulations that are put in place to protect policyholders living in the state. Under state law, all Kentucky health insurance plans are required to cover certain medical services, including:

  • Mammograms
  • Diabetes care
  • Medical care for pregnant women
  • Hearing aids for children
All Kentucky medical insurance plans are guaranteed renewable, which means an insurer cannot cancel coverage if a policyholder gets injured or sick. Kentucky insurance providers are also required to uphold mental health parity, which means they must cover mental health conditions at an equal level as physical health conditions.

Kentucky has a standard health insurance plan that must be provided by all health insurance companies. In this state standard plan, the benefits will be the same through every company, but the prices for premiums may vary. The standard plan options include Fee-For-Service (FFS) indemnity plans, HMOs (Health Maintenance Organization), Point-of-Service (POS) plans, and PPO (Preferred Provider Organization) plans.

Under federal law HIPAA, Kentucky insurance providers are not allowed to require coverage waiting periods or exclusion periods for eligible individuals searching for a plan in the private market after leaving a group health plan.

Kentucky Health Insurance High Risk PoolThe Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Residents in Kentucky with pre-existing conditions will be able to get health insurance coverage from the Pre-Existing Condition Insurance Plan (PCIP). This works similar to regular Kentucky health insurance policies and requires enrollees to pay affordable premiums and out-of-pocket costs.

Those eligible for the Kentucky PCIP pay around the same amount that people without medical conditions pay for health insurance. The estimated monthly premium cost for Kentucky residents is $304 for ages 0 to 34; $365 for ages 35 to 44; $466 for ages 45 to 54; $649 for ages 55 and older. The plan includes a $2,500 deductible that must be met before health insurance kicks in and has an out-of-pocket limit set at $5,950. Enrollees of the Kentucky PCIP will get access to health insurance coverage for hospital and doctor visits, emergency room services, prescription drugs, and more.

Individuals may apply for the Kentucky health insurance program if they are a United States’ citizen, have an existing medical condition, and have been without health insurance for six months. Kentucky Medical Insurance and Health Care Programs

The state of Kentucky offers residents quite a few public health insurance programs to assist low-income residents in getting access to affordable health care and insurance coverage. These programs include:

  • Medicaid
