New Hampshire Medical Insurance Laws, Regulations & Policies

There are several New Hampshire health insurance laws and regulations that are put in place to protect policyholders living in the state. New Hampshire insurance providers will consider a resident’s current health status and health history before accepting applications and setting premiums.

However, residents who are HIPAA-eligible have certain protections in the private health insurance market. Under this federal law, New Hampshire insurance providers are not allowed to refuse coverage for residents if they previously had insurance with a former employer’s group plan.

Even though New Hampshire insurance providers aren’t required to accept all applicants, all health plans must cover certain medical services under New Hampshire health insurance law. Those services include:

  • Patient costs of some clinical trials
  • Mammograms
  • Diabetes care
  • Certain bone marrow transplants
  • Care for pregnant women
  • Contraceptives
New Hampshire health insurance law also requires mental health parity, which means insurance companies must set coverage limits for mental health conditions equal to physical conditions.

New Hampshire Health Insurance Resources

Medical Assistance in New HampshireEligibility requirements are outlined for the various programs available in New Hampshire. Visit the website.

New Hampshire Bureau of Maternal and Child HealthThe Bureau of Maternal and Child Health strives to improve the availability of preventive and primary health care for all children and provide access to reproductive health care for all women and their partners regardless of their ability to pay. Visit the website.

New Hampshire Health Insurance High Risk PoolThe Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Residents in New Hampshire with pre-existing conditions are able to get health insurance from the New Hampshire Health Plan (NHHP-Fed). This works similar to regular New Hampshire health insurance policies and requires enrollees to pay monthly premiums and out-of-pocket costs.

Enrollees in the New Hampshire program pay around the same amount that people without medical conditions pay for health insurance. The estimated monthly costs for New Hampshire residents range from $283 to $1,691 a month – smokers face the higher premiums. The plan includes a $1,000 deductible for in-network visits and $2,000 for out-of-network visits. There is also a $300 drug deductible. Residents who are eligible for the plan will get access to health insurance coverage for hospital and doctor visits, emergency services, prescription drugs, and more.

Individuals may apply for the New Hampshire Health Plan if they are a United States’ citizen, have an existing medical condition, and have been without health insurance for six months. For more information on the New Hampshire health insurance high risk pools visit http://www.nhhp.org/nhhp-fed/index.asp.
