Colorado Medical Insurance Laws, Regulations & Policies

There are several Colorado health insurance laws and regulations that are put in place to protect policyholders living in the state, and Colorado insurance providers are required to follow set guidelines. According to state law, every Colorado medical insurance plan is guaranteed renewable. This means that insurance companies cannot cancel coverage if a policyholder gets sick or injured.

According to state law, Colorado health insurance plans must cover certain medical services and screenings, including:

  • Screening for breast and prostate cancer
  • Treatment for certain diabetes-related conditions
  • Continuity of medical care for pregnant women
  • Vaccinations for children
The state also requires Colorado insurance providers to follow mental health parity, which means that coverage limits and maximums for mental health conditions must be set equal to those for physical conditions.

Residents in Colorado have protection under the federal law HIPAA. Colorado insurance providers are not allowed to exclude coverage or require waiting periods for residents applying for an individual health plan after leaving an employer’s group plan. Residents can also receive continuation of group health coverage from a former employer under the federal law COBRA. Workers may keep coverage for up to 18 months with Colorado’s continuation coverage, and eligible employees can purchase a conversion policy after COBRA benefits are used.

Colorado Health Insurance High Risk PoolThe Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to those with pre-existing conditions. Residents in Colorado with pre-existing conditions can get health insurance coverage through the GettingUsCovered program. This works similar to regular Colorado health insurance plans and requires enrollees to pay monthly premiums and out-of-pocket costs.

Enrollees in the Colorado GettingUsCovered program pay around the same amount that people without medical conditions pay for health insurance. The estimated monthly premiums to Colorado residents will range from $115 for children aged 0 to 18 to $806 for a 60—64 year old. There is also a $2,500 deductible for medical services and a $500 deductible for medications. The out-of-pocket limit is set at $5,950, and residents who are eligible for the Colorado plan get access to health insurance coverage for hospital and doctor visits, emergency services, prescription drugs, and more.

Individuals may apply for the GettingUsCovered program if they are a United States’ citizen, have an existing medical condition, and have been without health insurance for six months. For more information on the Colorado health insurance high risk pool visit https://www.gettinguscovered.org.
