Georgia Medical Insurance Laws, Regulations & Policies

There are several Georgia health insurance laws and regulations that are put in place to protect policyholders living in the state. Under state laws, all Georgia medical insurance plans must cover certain medical care services. Those medical services include:

  • Care for children’s clinical trials for anyone diagnosed with cancer before turning 19 years old
  • Screening for breast, colorectal, cervical, prostate, and ovarian cancer
  • Certain diabetes-related care
  • Vaccinations for children
In Georgia, residents are protected by federal laws COBRA and HIPAA if they are searching for an individual health insurance plan after leaving an employer’s group coverage. COBRA gives former employees the right to stay on their employer’s group insurance coverage for a temporary period after their employment ends. Under HIPAA, Georgia insurance providers are not allowed to impose waiting periods or exclusion periods for pre-existing health conditions. Georgia health insurance law also requires that all HIPAA-eligible residents have guaranteed access to a health plan.

Georgia Health Insurance High Risk PoolThe Patient Protection and Affordable Care Act established temporary national high risk pools to provide health insurance to people with pre-existing conditions. The Pre-Existing Condition Insurance Plan (PCIP) in Georgia works similar to regular medical plans and requires enrollees to pay monthly premiums and out-of-pocket expenses

Enrollees in the Georgia PCIP pay around the same amount that people without pre-existing conditions pay for health insurance. The estimated monthly premiums for Georgia are $323 for ages 0 to 34; $387 for ages 35 to 44; $495 for ages 45 to 54; and $688 for ages 55 and older. In Georgia, there will also be a $2,500 deductible for covered medical expenses with an out-of-pocket limit set at $5,950. Residents who are eligible for the plan get access to health insurance coverage for physician and hospital visits, emergency services, prescription drug coverage, and more.

The state of Georgia offers residents quite a few public health insurance programs to assist low-income residents in getting access to affordable health care and insurance coverage. These programs include:

  • Medicaid
